Best interest of minor children

In our law the High Court, as upper guardian of all minor children, shall only grant a decree of divorce if proper arrangements between parties have been made with regards to the best interest of the minor children.

The Divorce Act, 1979 also clearly stipulates that no court shall be allowed to grant a decree of divorce until it is satisfied that the arrangements with regard to the welfare of the divorcing parents’ children are satisfactory or the best that can be achieved in the circumstances.
